Monthly $100 Gift Card Contest

Official Rules

No Purchase Necessary to Enter or Win. MAKING A PURCHASE OR PAYMENT OF ANY KIND WILL NOT IMPROVE YOUR ODDS OF WINNING.

1. Eligibility: The Monthly $100 Gift Card Contest (the “Contest”) is open exclusively to legal residents of the fifty (50) United States or the District of Columbia who are at least eighteen (18) years old.  Employees of DRMTLGY, LLC and any companies involved in promoting the Contest, along with their immediate family members (spouse, parents, siblings, and children) and household members, are not eligible to participate.  The Contest is governed by applicable federal, state, and local laws and is void in Rhode Island, Puerto Rico, and anywhere else prohibited by law. 
2. Sponsor: The Contest is sponsored by DRMTLGY, LLC (the “Sponsor”). 
3. Agreement to Official Rules: By taking part in the Contest, entrants fully and unconditionally agree to these Official Rules and to all decisions made by the Sponsor, which are final and binding.  Receiving a prize depends on satisfying every requirement described here.
4. Entry Period: The Contest opens on the first day of each month at 12:01am Pacific time and closes on the first day of each month at 12:01pm Pacific time.  Entries received outside the Entry Period will not qualify.  All mailed entries must be postmarked by the applicable deadline.  Entries submitted before or after the Entry Period will be disqualified. 
5. How to Enter: 
   1. Follow our page on Instagram, then like and comment on the designated post. 
   2. All entries sent by mail must be hand-printed.  There is no cap on how many entries a person may submit, however entries generated through agencies or through robotic, repetitive, automated, programmed, or comparable methods, or via fraudulent email accounts, will not be accepted.  Copies, facsimiles, or reproductions are not permitted.  Entries containing inappropriate content or language, including profanity, will be disqualified at the Sponsor's sole discretion. 
6. Drawing: Following the close of each Entry Period, the Sponsor will review all entries received and randomly select one entry as a potential winner.  Odds of being chosen depend on the total number of entries received.  The Sponsor will attempt to reach the potential winner within five (5) days of the drawing by email or Instagram.  If the potential winner cannot be reached within five (5) days of the first attempt, the Sponsor may randomly select an alternate winner from the remaining entries.
7.  Requirements of Potential Winners: A potential winner may need to complete and return an affidavit of eligibility and liability/publicity release (the “Affidavit/Release”) within five (5) days of notification.  Failure to sign and return the Affidavit/Release within that window results in disqualification, and an alternate entrant may be selected using the same process described above.  If the potential winner is a minor, a parent or legal guardian must sign the Affidavit/Release on their behalf.
8. Prizes: A single prize will be awarded to one winner. The prize consists of a $100 DRMTLGY gift card.  Any prize details not otherwise specified will be determined at the Sponsor's sole discretion.  Prizes cannot be transferred, exchanged for cash, or refunded, and must be accepted as awarded.  No substitutions are permitted except by the Sponsor, who reserves the right to substitute a prize (or part of it) with one of equal or greater value if the original prize becomes unavailable for any reason, as determined solely by the Sponsor.  The winner is responsible for any costs or expenses beyond what is described above.  Prizes may be considered taxable income, and the winner is responsible for any associated taxes. 
9. Privacy and Publicity: Information submitted by entrants will be handled in accordance with DRMTLGY's Privacy Policy, available at /pages/privacy-policy.  Except where prohibited, entering the Contest means the entrant consents to the Sponsor's use of their name, likeness, voice, opinions, biographical details, and state of residence for promotional purposes across any media, without additional compensation.
10. General Conditions: Should the operation, security, or administration of the Contest be compromised for any reason, including fraud, a virus, or another technical issue, the Sponsor may, at its sole discretion, either (a) pause the Contest to resolve the issue and then resume it in a manner consistent with the spirit of these Official Rules, or (b) award prizes at random among the eligible entries received up to that point.  The Sponsor reserves the right to disqualify any individual found tampering with the entry process, violating these Official Rules, or acting in a disruptive or unsportsmanlike manner, or with intent to threaten, harass, or otherwise disturb any other person.  Attempts to undermine the legitimate operation of the Contest may violate criminal and civil law, and the Sponsor reserves the right to pursue damages to the fullest extent permitted.  The Sponsor's failure to enforce any provision of these Official Rules does not waive that provision.  In case of a dispute regarding an online entry, the authorized holder of the email account used to enter will be considered the participant.  The “authorized account holder” is the individual assigned an email address by an internet or online service provider, or another organization responsible for assigning addresses for the domain tied to the submitted email.
11. Release and Limitations of Liability: By entering the Contest, participants agree to release and hold harmless the Sponsor and its parent company, officers, directors, employees, and agents (the “Released Parties”) from any claim or cause of action arising from participation in the Contest or from receiving or using any prize, including but not limited to: (a) technical errors preventing entry submission; (b) unauthorized human interference with the Contest; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in administering the Contest or processing entries; or (f) injury, death, or property damage caused directly or indirectly by participation in the Contest or receipt of a prize.  Entrants further agree that the Released Parties' liability, in any cause of action, is limited to the cost of entering and participating in the Contest, and the Released Parties will never be liable for attorney's fees.  Entrants waive any right to claim damages of any kind, including punitive, consequential, direct, or indirect damages.
    The Released Parties are not liable to winners or any other person for failing to deliver prizes, in whole or in part, due to acts of God, actions, regulations, orders, or requests from any governmental or quasi-governmental body (regardless of validity), equipment failure, terrorism, earthquake, war, fire, flood, explosion, severe weather, hurricane, embargo, labor dispute or strike (legal or otherwise), labor or material shortage, transportation disruption, work slowdown, civil disturbance, insurrection, riot, or any other cause outside the Released Parties' control.
12. Disputes: Except where prohibited, entrants agree that any disputes, claims, or causes of action related to the Contest or any awarded prize will be resolved individually, without recourse to class action, and exclusively in the appropriate court in the State of California.  All matters concerning the construction, validity, interpretation, and enforceability of these Official Rules, entrants' rights and obligations, or the Sponsor's rights and obligations regarding the Contest, are governed by and construed under the laws of the State of California, without regard to conflict-of-law principles that would apply the laws of any other jurisdiction.
13. Contest Results and Official Rules: To request a list of winners, send a self-addressed, stamped envelope to DRMTLGY, LLC, .  Vermont residents may omit return postage on the self-addressed envelope.  Requests must be received within four (4) weeks of the end of the Entry Period.  To obtain a copy of the Official Rules, mail a self-addressed stamped envelope to the address above marked “[Name] Contest” for receipt.
